Contributions of Decree 40/10: clarification energy efficiency

17/05/10 - In response to certain questions Reeds, the Ministry of Development has clarified the procedures to take advantage of the contributions of DL 40/10 for the purchase of energy-efficient homes. The Ministerial Decree of 26 March 2010, issued in implementation of Decree 40/2010, defined the contributions by sharing resources for each sector:

- 60 million for the purchase of buildings with high energy efficiency,

- € 40 million for the purchase of tower cranes,

- € 20 million for the purchase of construction equipment,

- € 8 million for the purchase of trailers, including semi-trailers.

 

The Ministerial Decree of 26 March 2010 also specifies, for each contribution, requirements and methods of disbursement of resources.

Contribution for buildings with high energy efficiency

Amount of grant

 

The amount of the contribution for buildings with high energy efficiency, is fixed (Article 2, paragraph 1, letter s) of the DM 26/3/2010) in relation to the improvement of primary energy demand for space heating of the property with respect to limits of the law and the surface area of the same: - 83 euro per square meter of usable area, up to a maximum of € 5,000 for each property, in case the energy performance is better than at least 30% compared to the values in Table 1.3, in Annex C 1, of Legislative Decree 192/05 to 116 euro per square meter of usable area, up to a maximum of € 7,000 for each property, in case the energy performance is better than at least 50% the values of Table 1.3 in Annex C 1, of Legislative Decree 192/05. Criteria for calculating the Ministry of Economic Development has made it clear that the useful floor area is necessary to refer to the definition of floor area contained in Annex A, pt.32, of Legislative Decree 192/05, or the net floor area of a building only refers to the heated parts. The data area of the house is still contained in the energy of the property (Appendix 6 of Annex A to DM 26/6/2009).

As for the values of primary energy for space heating to be achieved, they should be calculated by reference to Table 1.3 Limit values'', applicable from 1 January 2010, for the annual needs of primary energy for space heating per square meter of surface Internal usable building, expressed in kWh/m2 year'', relating to residential buildings contained in Annex C of the Legislative Decree 192/05. For the calculation of the energy performance must be based on the framework outlined by the Legislative Decree 192/05, including amendments and additions made by the Legislative Decree 311/06 and by the decrees subsequently published, with particular reference to the methods of calculation, the reference standards, the characteristics of the software used (Presidential Decree 59/2009 and Ministerial Decree of 26 June 2009'' national guidelines for energy certification of buildings "). Ministry has clarified that in any case are also valid energy performance certificates issued in accordance with regional laws as long as the Energy Performance certified is determined by the calculation methods laid down in the decrees of the Legislative Decree 192/05, so as to ensure the normal take the measure of the whole national territory.

 

Certification and certification subject

The energy performance required to be certified according to the procedures established by Legislative Decree 192/05 and subsequent amendments, within the notes of energy performance certificates, must be a specific percentage reduction of the index of performance (at least 30% or 50% of primary energy demand for space heating).

With regard to the accredited subject, which must release the energy certification, reference should be made to Annex III, paragraph 2 of Legislative Decree 115/2008. Annex III of the Legislative Decree 115/08 states that are recognized as Subjects certifying the'' qualified technicians, "or technicians working both as employees of corporations and public bodies or public or private service companies (including engineering company) that are free or associated professionals, enrolled in the orders and colleges professional, and admitted to practice relating to the design of buildings and installations. If the technician does not have jurisdiction in the fields mentioned above, he must work in partnership with other qualified technician so that the group constituted covering all professional fields on which expertise is required. should however be ensured the independence and impartiality of judgment of Subjects certifiers, except in the case of electrically qualified employees who work on behalf of public authorities or public bodies operating in the energy sector and building.

 

Further requirements

Additional requirements for applicants for funding related to the property that must be newly built and purchased as a first home of the family. The Ministry in this regard has made it clear that the requirements of new construction'' 'and'' first home of the family "are essential both in the case of properties with primary energy demand by at least 30% better than the values referred to in Legislative Decree 192 / 05 for both properties with primary energy demand by at least 50% better.'s contribution is expected for new buildings as defined by Legislative Decree 192/05, ie those for which the application for a permit to construct or complaint logins, however named, was submitted after the date of entry into force of the decree, or after 8 October 2005, also including the demolition and reconstruction of the buildings, but the renovations, for which there are other forms of facilitation.

How to access the contribution

For the purchase of buildings with high energy efficiency is not practiced price reduction but the contribution will be recognized directly to the purchaser. It is necessary that the agreement of purchase of the property has been entered into a deed of certain date following the date of entry into force of the decree, or after 6 April 2010, and the final contract of sale is concluded by 31 December 2010.

The seller must be assigned an identification code'''' to use for bookings of contributions. This identification number will be provided upon registration, to be made by calling the toll-free number 800 556670 until May 16 and through the website of the Ministry of Economic Development from May 17 onwards.

To this end, the seller will provide the tax code, the code REA and province, postal code and the location of the headquarters of the year. In the 20 days preceding the signing of the final contract of sale, the seller will have to proceed to the booking of the contribution from the Italian Post Office (subject relied upon by the Ministry of Economic Development), subject to availability of financial resources, by calling toll free 800 556 670 to May 16 or the website of the Ministry http://www.sviluppoeconomico.gov.it/ in'' 2010'' special incentives from 17 May onwards.

 

For the reservation of the contribution shall provide the following data:

- Sector of the product belongs (ie buildings with high energy efficiency)

- Type of product (better energy performance of 30% or 50% compared to the limits set out in Decree)

- Usable on which the contribution is calculated (indicated in the energy)

- The number of the buyer (tax code and data bank for subsequent crediting of contributions)

- Basic price (inclusive of VAT) You will then be given a booking reference number.

At the time of signing of the final contract of sale, in order to obtain contributions, must be confirmed booking your contribution. The contract must be written in the incentive and attached the energy performance certificate.

 

Financial assistance
